Authorities are reporting a 74-year-old passenger on-board MSC Divina is missing and presumed overboard.  The man’s disappearance comes just days after a 22-year-old man and a 74-year-old woman went overboard the Royal Caribbean’s Independence of the Seas and the Queen Mary 2, respectively.

According to reports, Mr. Jeon Pierre Knorr, a French citizen traveling with his wife stepped onto the room’s balcony for some fresh air at approximately 3:00 a.m. on Monday and did not return. When his wife got up several hours later, she realized he had not returned and reported him missing.

The circumstances of his fall, however, remain unknown.  Cruise ship officials searched the entire cruise ship and made callouts through the public announcement system with no success.

22-Year-Old Passenger Overboard Royal Caribbean Cruise Ship

A 22 year-old male Royal Caribbean passenger on-board the Independence of the Seas was reported as having intentionally jumped off the ship’s twelfth deck in the early morning hours of Thursday, December 22, 2016.  The ship was approximately 33 miles southeast of Key Largo and was heading back to South Florida after a four-night trip.

The ship contacted the U.S. Coast Guard which took over the search of the man by air and sea.  After a 38-hour search for the missing man, the Coast Guard suspended the search Friday afternoon.

Just a day after the 22-year-old man was reported missing, news sources reported a 74-year-old British woman on-board the Queen Mary 2 ocean liner was missing and presumed overboard. The ship had left New York Thursday morning and was en route to St. Martin in the Caribbean.  The woman was reported missing in the early hours of Friday morning when the ship was around 100 miles south east of Atlantic City in New Jersey.  The search for the woman was called off Friday evening.

Toddler Nearly Drowns Aboard Carnival Splendor

A 2-year-old boy has been hospitalized after nearly drowning aboard the Carnival Splendor. According to reports, Saturday around 3:00 p.m. while the ship was docked at Port Miami, the toddler’s mother lost sight of him briefly and minutes later found him in one of the ship’s pools. A passenger aboard the ship who is a paramedic rendered assistance and the child was taken to the ship’s infirmary. The toddler was then transferred by local emergency personnel to Jackson Memorial Hospital. The toddler was reportedly conscious and stable at the time of his transfer to the hospital. We sincerely wish the young child a speedy recovery and send our best to his family.

Just three months ago, we reported on the tragic death of an 8 year-old-boy aboard Royal Caribbean’s Anthem of the Seas. Still, cruise lines continue to refuse to provide lifeguards on their ships claiming they comply with all safety requirements by posting visible signs alerting passengers to the fact that a lifeguard is not on duty and that children under 12 must be accompanied by an adult at all times.

Carnival carries approximately 700,000 children a year aboard its ships. While failing to provide lifeguards to protect children, it advertises and promotes, unlimited all-inclusive beverage packages with its Cheers! Program. No doubt, parents must supervise their children but cruise lines should be required to protect the safety of their passengers by implementing simple safety measures such as lifeguards.

Hurricane Mathew Forces Cruise Ships to Alter Itineraries

Hurricane Matthew is causing multiple cruise ships including the Carnival Sensation, Carnival Splendor and Royal Caribbean’s Enchantment of the Seas and Majesty of the Seas to alter their itineraries as the storm travels Cuba and the Bahamas. Several cruise ships will avoid travel to the Bahamas and will instead head to Key West, Florida and Cozumel, Mexico.

Hurricane Matthew is causing multiple cruise ships including the Carnival Sensation, Carnival Splendor and Royal Caribbean’s Enchantment of the Seas and Majesty of the Seas to alter their itineraries as the storm travels Cuba and the Bahamas. According to reports, the storm made landfall in Haiti early this morning carrying winds of 145 mph causing devastating damage to the island. Hurricane Matthew is expected to pass over eastern Cuba and portions of the Bahamas later today then heading toward the US, dropping down to a category 3 with 120 mph winds.

The United States Coast Guard Captain for South Florida Ports has set port condition whiskey for Port Miami, Miami River Port Everglades, Port of Palm Beach, Port of Ft. Pierce and all other South Florida terminals and facilities due to the storm’s expected track near southwest Florida.

Vessels bound for South Florida unable to depart prior to Hurricane Matthew making landfall are being advised to seek an alternate destination. Additionally, vessels desiring to remain in port have to obtain permission and submit a safe-mooring plan in writing.

Injured Carinval Cruise Passenger Medevaced off Louisiana Coast

The Coast Guard is reporting that it medevaced a 60-year-old woman passenger from the Carnival Triumph cruise ship. Coast Guard Sector New Orleans received a call at 8:43 pm on Monday, September 26th, from the Carnival Triumph requesting a medevac of one of its passengers who was injured during the cruise. The request was related to Coast Guard Station Venice who dispatched a 45-foot response boat which met the cruise ship approximately seven miles off the Venice, Louisiana coast at 9:39 p.m. The injured passenger and her husband were transported to emergency medical services at the Venice Coast Guard Station. The couple were then transported by ambulance to Ochsner Medical Center in Kenner. The passenger is listed in stable condition. It is unknown at this time what caused the injury. The Carnival Triumph is currently sailing a Western Caribbean itinerary from New Orleans.

Second Crewmembers Dies in Norwegian Breakaway Lifeboat Drill Accident

A second crewmember has died from the July 20th incident wherein a lifeboat fell from the NCL operated Norwegian Breakaway while docked at Kings Wharf, Bermuda. As previously reported by The Maritime Law Blog, four crewmembers fell into the water when a lifeboat they were manning during a drill broke from its tether. Four of the crewmembers were taken to an area hospital were Diogenes Carpio died from his injuries. One of there other crewmembers, Ben Buenaventura, who was a waiter aboard the Norwegian Breakaway, was medevaced to Jackson Memorial Hospital in Miami wherein he was admitted into the intensive care unit. It was reported that Mr. Buenaventura suffered a traumatic brain injury along with fractured legs, hip and right arm. After spending over a month in intensive care, Mr. Buenaventura succumbed to his injuries.

NCL is not the only cruise line that had a fatal lifeboat drill in recent months. On September 13th, a seaman died when a lifeboat fell from Royal Caribbean’s Harmony of the Seas while calling on Marseilles, France.

One crew member was killed and four others were injured-two critically, after a lifeboat became detached and fell from the fifth deck of the Royal Caribbean Harmony of the Seas during a security drill while the ship was docked in Marseille, France. The lifeboat is estimated to have fallen from a height of approximately 32 feet with the five men inside of it. The man killed is reportedly a 42-year-old man from the Philippines.

The Harmony of the Seas is the world‘s largest cruise ship at 1,188 feet from bow to stern it is longer than the Eiffel Tower. The ship is cruising the Mediterranean and is expected to continue its sail to Naples, Italy.

Earlier this year, we reported on a similar accident that occurred aboard the Norwegian Breakaway, which resulted in the death of a crew member and injuries to three other crew members.

A Federal appellate circuit court in Atlanta has ruled that a United States crewmember must arbitrate his personal injury claim. This case involved a lead trumpeter who worked for a Miami, Florida based cruise line based aboard a cruise ship whose home port is Ft. Lauderdale, Florida. At the time of the injury, the cruise ship sailed two routes. A Western Caribbean route which called on Haiti, Jamaica and Mexico and an Eastern Caribbean route which called on the United States Virgin Islands, the Bahamas and St. Maarten. No matter which route the cruise ship took, it always began and concluded the voyage in Ft. Lauderdale.

The crewmember brought his personal injury claim against his cruise line employer alleging that it failed to provide him with adequate medical care as required under the Federal Jones Act and the maritime employer’s obligation to provide an injured seaman with medical care. The crewmember allowed alleged the cruise ship was unseaworthy. The cruise line asked the court to dismiss the lawsuit and compel arbitration pursuant to the employment contract which required that all disputes, “be referred to and resolved exclusively by mandatory binding arbitration pursuant to the United Nations Conventions [sic] on the Recognition and Enforcement of Foreign Arbitral Awards.” The trial court dismissed the lawsuit in favor of arbitration and the crewmember appealed.

Regardless of which route cruise, sailing it always starts and ends in Fort Lauderdale.

Cruise lines crew brought him in personal injury claims employers claiming it failed to provide him with proper medical service, under the Federal Jones Act and maritime employers ‘ obligation to provide medical services for injured seafarers requirement. Allow: flight attendants said the cruise ship is not seaworthy. Cruise line asked the Court to dismiss the lawsuit, forcing arbitration in accordance with the contract of employment, require all disputes, “means to solve entirely by mandatory binding arbitration, under the United Nations Convention [sic] to the recognition and enforcement of foreign arbitral awards.
