Toddler Nearly Drowns Aboard Carnival Splendor

A 2-year-old boy has been hospitalized after nearly drowning aboard the Carnival Splendor. According to reports, Saturday around 3:00 p.m. while the ship was docked at Port Miami, the toddler’s mother lost sight of him briefly and minutes later found him in one of the ship’s pools. A passenger aboard the ship who is a paramedic rendered assistance and the child was taken to the ship’s infirmary. The toddler was then transferred by local emergency personnel to Jackson Memorial Hospital. The toddler was reportedly conscious and stable at the time of his transfer to the hospital. We sincerely wish the young child a speedy recovery and send our best to his family.

Just three months ago, we reported on the tragic death of an 8 year-old-boy aboard Royal Caribbean’s Anthem of the Seas. Still, cruise lines continue to refuse to provide lifeguards on their ships claiming they comply with all safety requirements by posting visible signs alerting passengers to the fact that a lifeguard is not on duty and that children under 12 must be accompanied by an adult at all times.

Carnival carries approximately 700,000 children a year aboard its ships. While failing to provide lifeguards to protect children, it advertises and promotes, unlimited all-inclusive beverage packages with its Cheers! Program. No doubt, parents must supervise their children but cruise lines should be required to protect the safety of their passengers by implementing simple safety measures such as lifeguards.

10-Year-Old Girl Drowns in Hilton Garden Inn Pool

There has been another child drowning in Florida. This time a 10-year-old girl drowned in a pool located at the Jacksonville/Ponte Vedra Hilton Garden Inn. Reports states that the girl identified as Raven Malden of Pensacola was swimming Saturday night with three other family members. She went underwater. Two other children tried to pull the girl from the pool while an older child whet to get help. The girl was removed from the pool and CPR was preformed. Upon arriving to the scene, paramedics took over resuscitation efforts and the child was taken to a Baptist Medical Center Beaches. Tragically, the child died.

This is the second incident within three months where a child has drowned in a Jacksonville area pool. The other incident occurred when a 5-year-old girl wondered into a neighbor’s pool on July 27th.

A cruise ship passenger traveling onboard the Carnival Splendor died last Wednesday due to a Jet Ski accident at Cockleshell Bay in Sports, the 40-year-old man from Texas rented a Jet Ski and while jet skiing had some difficulty falling from the personal watercraft into the water. Friends assisted him to shore and Emergency Medical Services transferred him to Joseph N. France General Hospital where he was later pronounced dead. We extend our deepest sympathies to his loved ones. Local agencies are investigating this incident.

Cruise lines often offer various watersports as shore excursions. While many cruise ship passengers believe that excursions offered by the cruise lines on their websites are operated by the cruise lines themselves that is rarely the case. A Federal appellate circuit court in Atlanta has ruled that a United States crewmember must arbitrate his personal injury claim. This case involved a lead trumpeter who worked for a Miami, Florida based cruise line based aboard a cruise ship whose home port is Ft. Lauderdale, Florida. At the time of the injury, the cruise ship sailed two routes. A Western Caribbean route which called on Haiti, Jamaica and Mexico and an Eastern Caribbean route which called on the United States Virgin Islands, the Bahamas and St. Maarten. No matter which route the cruise ship took, it always began and concluded the voyage in Ft. Lauderdale.

The Federal Eleventh Circuit recently found that a Miami-Dade County canal popular for boating and fishing is not navigable thereby precluding claims based upon Federal admiralty jurisdiction. Since Federal admiralty jurisdiction does not exist, Florida state law, not Federal maritime law applies to boating accidents that occur in many South Florida canals.

The Accident

A privately owned pleasure boat was operating in a waterway known as the Coral Park Canal. While the boat was traveling south, it encountered a bridge with low clearance at the intersection of SW 94th Avenue and SW 8th Street. The operator and four passengers lowered their heads while the vessel passed under the bridge. As the boat emerged from the other side of the bridge, one passenger raised his head and hit a water pipe owned by Miami-Dade County that extended over the canal. The force of the impact ejected the passenger from the boat and into the canal causing a significant personal injury.
